TERMS AND CONDITIONS
1. INTRODUCTION These Terms and Conditions ("Terms") constitute a legally binding agreement governing access to and use of the RetroLens website and all purchases of Goods from RetroLens ("RetroLens", "we", "us", "our"). By placing an Order or otherwise transacting with us, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. DEFINITIONS For the purposes of these Terms:
"Goods" shall mean all products sold by RetroLens, including but not limited to second-hand cameras, brand new cameras, film cameras, accessories, parts, and related items.
"Order" shall mean any request by a Buyer to purchase Goods via our website or Telegram channel.
"Buyer" / "you" shall mean the individual or entity placing an Order.
3. APPLICABILITY These Terms shall apply to all transactions with RetroLens across all sales channels. Where Goods are purchased via third-party platforms, the terms and policies of such platforms may additionally apply and, in the event of inconsistency, may take precedence to the extent required. No variation, modification, or waiver of these Terms shall be binding unless expressly agreed in writing by RetroLens.
4. NATURE OF GOODS AND DISCLAIMERS
4.1 PRE-OWNED GOODS All second-hand Goods are sold on an "as is" basis and may exhibit signs of wear and use consistent with their age, prior usage, and pricing. In accordance with the Consumer Protection (Fair Trading) Act (Singapore), the standard of satisfactory quality for second-hand Goods shall be assessed with reference to such factors.
No remedy shall be available in respect of any defect, condition, or issue that was disclosed, visible in the listing materials, or reasonably apparent upon inspection.
4.2 COSMETIC CONDITION Pre-owned Goods may contain cosmetic imperfections including but not limited to scratches, scuffs, paint loss, brassing, rubber wear, dents, or surface degradation.
Brand new Goods may contain minor manufacturing marks or finishing variations arising from production processes.
Such imperfections are inherent in the nature of the Goods, do not affect functionality, shall not constitute defects, and shall not entitle the Buyer to any return, refund, exchange, or claim.
4.3 TECHNICAL LIMITATIONS By reason of the age and nature of the Goods:
Batteries shall be treated as consumable items and no representation or warranty is made as to their lifespan or performance.
Optical elements may contain minor dust, haze, or age-related imperfections that do not materially affect image output.
Digital screens and sensors may exhibit minor imperfections, including but not limited to dead pixels or other age-related display variations.
Certain performance characteristics inherent to pre-owned cameras shall not constitute a defect.
No representation or warranty is made as to durability, longevity, or continued performance of any Goods.
4.4 NO GRADING REPRESENTATION RetroLens does not adopt any standardised grading system. All Goods are described through photographs and written descriptions, which shall form part of the contract. The Buyer shall be responsible for reviewing all listing materials prior to purchase.
4.5 DEFINITION OF DEFECT AND CLAIMS LIMITATION For the avoidance of doubt, a "defect" shall refer strictly to a failure of a core functional component of the Goods that materially affects usage or output, including but not limited to non-functioning buttons, shutter failure, or flash failure.
Performance variations inherent to pre-owned cameras, minor imperfections including but not limited to cosmetic wear, dead pixels, or other age-related display variations shall not constitute defects.
No claim shall be entertained in respect of any condition, defect, or issue that was disclosed, visible, or reasonably foreseeable from the listing materials.
4.6 PRODUCT REPRESENTATION All product images are provided for reference purposes only. Actual colour, appearance, and condition may vary due to lighting conditions, display settings, and the inherent nature of pre-owned Goods. Such variations shall not constitute defects and shall not give rise to any entitlement to return, refund, or exchange.
4.7 DATA LOSS DISCLAIMER Due to the inherent risks associated with vintage digital cameras and storage media, RetroLens shall not be liable for any loss, corruption, or damage of images, videos, or data captured or stored using the Goods (including but not limited to memory cards) under any circumstances.
5. ORDERS, PRICING AND PAYMENT All prices shall be stated in Singapore Dollars (SGD) and shall be exclusive of GST unless otherwise specified. Payment shall be made in full at the point of purchase. For international Orders, the Buyer shall be solely responsible for all applicable customs duties, taxes, and import charges.
6. SHIPPING, DELIVERY AND RISK
6.1 TRANSFER OF RISK Risk in the Goods shall pass to the Buyer immediately upon delivery of the Goods to the courier or postal service. RetroLens shall not be liable for any loss, delay, or damage occurring in transit.
6.2 DELIVERY DETAILS The Buyer shall be responsible for providing accurate and complete delivery information. RetroLens shall not be liable for failed deliveries arising from incorrect or incomplete address details.
6.3 UNCLAIMED PARCELS Goods that are unclaimed, rejected, or returned may be subject to restocking fees and additional delivery charges.
7. WARRANTY AND REMEDIES
7.1 WARRANTY All Goods come with a 7-day warranty covering camera functionality from the date of receipt.
To qualify for a warranty claim:
- The Buyer must provide a full, continuous, unedited video demonstrating the issue; and
- Notification must be made within seven (7) calendar days from the date of delivery.
For Dead-on-Arrival ("DOA") claims, strictly defined as Goods that are completely unable to power on:
- The Buyer must provide a full, continuous, unedited unboxing video; and
- Notification must be made within three (3) calendar days from the date of delivery.
Failure to comply with these requirements shall result in automatic rejection of the claim.
The warranty does not cover:
- Performance variations inherent to pre-owned cameras
- Accidental damage, drops, or water damage
- Cosmetic issues including scratches, scuffs, or surface wear
- Battery degradation or performance
- Any issues arising from misuse or modification of the Goods
- Any issues arising after the 7-day warranty period
7.2 ONE-TIME EXCHANGE Any exchange or remedy granted under the 7-day warranty or DOA claim shall be strictly a one-time goodwill gesture at the sole and absolute discretion of RetroLens. No further exchanges, replacements, or claims shall be entertained thereafter. Where no suitable exchange is available, a refund may be issued in the form of store credit valid for a period of three (3) months.
8. RETURNS AND DISPUTE PROCESS
8.1 UNBOXING REQUIREMENT A full, continuous, unedited unboxing video shall be mandatory for all claims relating to DOA, physical damage, or incorrect items. In the absence of such video, any damage shall be conclusively deemed to have occurred after delivery.
8.2 RETURNS PROCEDURE All returns shall require prior authorisation. Goods must be returned for inspection. RetroLens reserves the right, at its sole discretion, to determine whether to repair, replace, or refund. Where applicable, any refund may be issued in the form of store credit valid for a period of three (3) months.
8.3 RETURN SHIPPING All return shipping costs shall be borne by the Buyer unless otherwise agreed in writing. The Buyer shall utilise a trackable shipping method. In the event of an invalid claim, the Buyer shall bear the cost of return shipment back to them.
9. LIMITATION OF LIABILITY To the fullest extent permitted by applicable law, RetroLens shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of data, images, videos, or revenue arising from the use of the Goods. In all circumstances, RetroLens' total aggregate liability shall not exceed the purchase price of the Goods.
10. CANCELLATIONS AND ERRORS RetroLens reserves the right to cancel any Order in the event of stock unavailability, pricing errors, or payment irregularities. Where payment has been made, a full refund shall be issued. Pre-order deposits shall be non-refundable except where RetroLens is unable to fulfill the Order.
11. INTELLECTUAL PROPERTY All content, including but not limited to text, images, logos, and designs, shall remain the property of RetroLens or its licensors and shall not be reproduced without prior written consent.
12. FORCE MAJEURE RetroLens shall not be liable for any failure or delay in performance arising from events beyond its reasonable control, including but not limited to natural disasters, pandemics, supply chain disruptions, or courier-related issues.
13. GOVERNING LAW AND JURISDICTION These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore. The parties hereby submit to the exclusive jurisdiction of the courts of Singapore.
14. AMENDMENTS RetroLens reserves the right to amend or update these Terms at any time without prior notice. Continued use of our services shall constitute acceptance of the revised Terms.
